There's an old saying, "Don't plan to fail" which is true here - the Curse team are very unlikely to have spent their precious time working on negotiations for what happens if they fail. It's just not a done thing in business.
If there are, way in the future, reasons for the D&D Beyond site to close, or for Curse itself to close, then we can be pretty certain that they'll come up with something then.
We know that the Curse team are massive D&D fans who won't want to fail the community and that ultimately they're owned by Amazon, who care about customer service.
This is a good question for dealings in digital content, though. Having some advance indication of the duration of the rights to access the material via D&D Beyond would be reassuring, particularly as both WotC and Curse are part of far larger companies. I noted, recently, that one digital movie website specifically said "we guarantee you'll have access to any film you 'buy' for 3 years and many of our content partners let us offer the film for longer." That information helps in making decisions about purchases. Is there a link to the D&D Beyond terms? The Twitch ones do not really cover what this site is doing.

No it isn't. I have a vast repository of digital goods that I own.
I will not be spending anywhere near as much as I was going to spend. In fact, I dont think ill be spending anything else at all until some updated ToS comes along. If Im only renting the things I pay for, I dont expect to pay the same thing I would pay to own it.
There is no functional difference between "I own this" and "I am renting this indefinitely for a one-time fee".
Nothing purchased, whether it's a "rental" or "own" arrangement, is actually literally forever - you can buy a book at your FLGS and own it until such an event as it is lost or destroyed, or you can buy a book here at D&D Beyond and own it until such an event as it is lost or destroyed.
The app has been stated to allow access to all content purchased OFFLINE already by the devs.
That means if dnd beyond fails, anyone who owns the app (and nothing is ever TRULY removed from the internet) will still have access to their offline material through said app.
Now if it somehow failed before the app is created which I suspect has a ZERO chance of happening, then I imagine you would be completely SOL
That is the only assurance I have as of right now, but this service is so useful and with constant plans to be updated I am not too concerned about it.

I've been an active user on many online games such as basically every MMO ever, and every MOBA ever, and many other online games and I've never been banned. Follow the rules and you're good to go.
