I get this error adding spells to a spell list for a subclass. I have gotten it for a few. All are Core Rules Spell, displayed as such when selecting. It is hit or miss. One example is Wrathful Smite (though Searing Smite worked).
This Subclass cannot be shared with the community for the following reasons:
This homebrew Subclass has data mapped to it that is licensed content or private homebrew. This typically occurs when licensed or private homebrew spells are linked to the Subclass.
The wording is a bit confusing. It's not about the spells being in the core rules; it's about whether they're in the free Basic Rules product that everyone has access to or not. Searing Smite is in the Basic Rules, but Wrathful Smite is not.
Keep in mind that you don't need to publish homebrew things unless you want strangers to be able to use them. Unpublished homebrew things can still be used by you and by anyone in your campaigns.
But, you can't make a character using only the Free Rules, you have to at least select Core Rules which includes PHB so you should be able to use any spells in that book, I get not other Expanded rules, etc.
Sources
You will only see character options from content you own and have enabled here in both the builder and your character sheet. Removing all sources will prevent you from being able to create a complete character.

Character options designed by other players and uploaded to D&D BEYOND. Talk to your DM before including Homebrew content.
Core Rules
Character options from the Player’s Handbook, Dungeon Master’s Guide, Monster Manual, and D&D Beyond Basic Rules.
Expanded Rules
Character options from supplementary sourcebooks beyond the Core Rules.
2014 Core Rules
Character options from the 2014 Player's Handbook, Dungeon Master's Guide, Monster Manual, and Basic Rules.
Legacy
Character options from older sources that may conflict with the Core Rules. These include sources that are out of print or created for charity.
You can certainly make a character using only content from the Basic Rules, though you're right that there isn't an option on that Sources screen to filter to that. Selecting "Core Rules" will not show content from the PHB if you don't own the PHB, though.
Regardless, you still can't link spells from paid content to a published homebrew subclass. You can put whatever you want in an unpublished homebrew subclass, which, again, you and people in your campaigns can use.
While there is a lot of overlap, the Basic Rules and the SRD are separate things that aren’t exactly the same. The Basic Rules are what’s relevant here.

yeah, they could be clearer about that - say SRD/Free Rules somewhere. I mean its really the SRD.
