My understanding of RoUI is that when the last patch has been removed, it becomes an ordinary garment.
If the Robe was one of your 4 magic items, and you use all the patches, how many magic items do you have as a level 10 Artificer? My understanding is that as an ordinary garment, while produced by Replicate Magic Item, it’s no longer part of that roster and new Magic items may be produced without destroying the earliest item.
The counter argument presented to me is that as it still exists it counts against that tally and would make the earliest item produced by Replicate Magic Item disappear if a new item (say, another RoUI) was created.
I have always played Infuse Item as if I can intentionally end an infusion if I wish, and I think Replicate Magic Item should work the same way, that you can intentionally end it. At 6th level, you could with the Drain Magic Item feature, which, interesting, does this mean that technically you could drain, get a spell slot, and then create your magic items for the day? (I would not allow that as a DM; I would say that's your use of the magic item slot for the day.)
The 2014 rules for Magical Tinkering work this way RAW and I think it's analogous.
Otherwise the world is just a hassle if the oldest thing you made is your bag of holding. Not fun and really makes no sense.
So I think (a) you could touch it and remove the last of its magic to allot to a new item, and (b) yes, your robe is no longer magical, so doesn't count against your items.
I was thinking the same: if my DM is still considering the expended Robe a magic item then the 6th level feature to convert it into, in this case, a second level slot should apply. That would drop the 4th item from the roster, freeing up another spot for after the next long rest to use Replicate Magic Item to create another RoUI. If he doesn’t consider an expended Robe a magic item, then the point is moot.
He’s complaining that it was something missed when they made the UA and that as it’s still just in playtesting that he can rule it however. Which I’d get but he’s forced everyone else into the 2024 rules without discussion. Can’t cherry pick in my opinion. He can fill out the survey like everyone else lol

As I see it, you have your Replicate Magic Item slot to use once a day. Your item can be continuing over from the previous day, or at the end of a long rest you can change it out. At any time during the day, you could use the Drain feature to turn it into a spell slot, which would last until your spell slots reset during the next long rest.
So, you could use your magic item all day, then turn it into a spell slot at the end of the day, and do something with that spell slot. But the spell slot is gone after your long rest. If you want it back in the morning, you can trade a magic item slot for it (technically, make the item at the end of a long rest, then unmake it into a spell slot at your leisure).
Ah maybe I didn’t explain my main concern well. My DM wants to force-delete my oldest magic item when I create another Robe after using up my first one the previous day. He’s saying that because the first robe still exists, it’s a magic item and creating a new one would delete not that used robe but the first item I created, like an Armor+1 or something. Say I created over two long rests:
Armor+1
Sentinel Shield
Rope of Climbing
Robe of Useful Items
Now, if I were to create just one more the third day (at level 10), it would make the Armor+1 to vanish. My thinking is that as soon as the robe’s patches are gone, it should drop from that list, and as such clear an open spot for a new Robe on day three. He wants to make it so that if I daily create new Robes, I’ll end up with 3 useless ordinary garments and 1 magical, nerfing me essentially.
My argument for getting daily robes is a) it’s RAW and b) that even given the most powerful patches (10 gems or the spell scroll) it only leads to funds for creating other magics items and when compared to loot from other quests it really isn’t OP. I just think it’s a funny random concept and feel like he’s just not letting an already mid-tier class not have fun lol
I’m not too concerned about the spell slot added by draining an item. Oh and technically you can make 1 OR 2 items per long rest with Replicate Magic Item ;) unless I misunderstood you!
(yes, I realize you can make two items, it was just simpler to be talking about the one.)
I mean, IMHO your DM's theory is just a silly way to read the rule and it's even worse with replicate items instead of infusions, because now you don't have armor at all.
Forcing out the oldest isn't how we run spell preparation, either.
For example, my artificer has a bag of holding. I have no intent to change the item. Then I swap around my other infusion slot(s) to be one of the other types known. The language is actually the same around ending, with no explicit callout that you can end an item intentionally, but I've always seen it interpreted that you can.
As your DM interprets it, I could not Replicate a new Magic Item (or change out my infusions) without unmaking my Bag of Holding every day. That seems ... strange.
And yes, I think both RAW and RAI you can make a new Robe of Useful Items every day. (By contrast, you can also make a new enspelled armor every day.)
