Leaving OGL 1.0(a) untouched and making SRD 5.1 CC-BY-4.0 is a great first step. The next is a promise to do the same for future editions. Here's a discussion thread on that.
You're not supposed to, but because the character builder doesn't know if you're building a character at level 1, level 3, or level 20, and because you can gain more spells during the course of the campaign if you do start out lower, the book of ancient secrets section of the builder has to be able to allow you to add more than just 2 spells. It just trusts you to know how many you're supposed to actually have at the moment, because it's not that smart a builder.
I just made a Warlock 9 test character with the Pact of the Tome and Book of Ancient Secrets, and this did not happen for me. You must have chosen every single spell when adding the invocation in the character building, meaning that's where you go to remove them as Pocketmouse said.

DDB is great, but it could be better. Here are some things I think could improve DDB
