I agree with Biowizard, Murder Hobo gets really overused if some one wants attack anything rather than for its context of someone that wants to attack everything.
wanting to kill the happy go lucky shop keeper to avoid paying for stuff - you might be a murder hobo
wanting to kill the pirate that killed your family - you are 50% of fictions protagonists
In these situations I sit back and watch it unfold. Given time and the expectation that the DM is not going to force anyone's hand the party will quickly find a solution one way or another.
The only time I would jump in is when things turn from a argument into an actual out of game fight. In such cases I would have both characters roll for it.
In the example given though, the second that the player says, "I attack with my sword", I would reply with roll to hit. The other player might ask to try and block and we would play from there.
