Harold stares in horror at the undead mage that is still somehow standing even as its bones and flesh smolder. That bravado he had when earlier is gone. He sees now just how bad things can be, as both his brother and the captain are covered in grievous wounds, and he has taken a few himself...
"I... I think my brother may be right," Harold says, clearly rattled by the news that there are more of .
He uses his turn taking the Dodge action as well as he only has melee options.
'Naut will go ahead and take a shot at the undead mage with his pistol... but he is at long range and so has disadvantage on the attack.

It was strange for Emrys to notice that the world had gone dark as another enemy spell took hold of the ship’s floor. A realization that came only when William spoke suggesting surrender. Poor bastard had no idea that that was the plan from the start. Gods, my head hurt. That was a good sign, specially considering that the rest of his body felt completely numb. The pain he felt was a sign that he was alive and well enough to keep some consciousness.
“I have no wish to throw away my life nor that of my crew because of a stupid job!” That should frame surviving as their priority. Make it believable that they had no loyalty to North.“The problem is that after dealing with so many of your friends surrendering looks an awful lot to just letting you kill us and if we are going to die either way… May as well keep fighting.” He tried his best to sound frustrated and stubborn. “But if you can assure that we’ll be taken prisoners and suffer no torment then the ship is yours!”
That should work. The fact that the pirates called for surrender means that keeping the battle would at the very least be too costly to them, if not too dangerous. More than that, it was part of the new Hailstorm’s modus operandi to recruit those who had the capability to fight so torture was likely never in the picture. Unless the damned dwarf is there we should raise no suspicion.
Notes: Emrys words are directed to the pirate calling for the crew's surrender. For brevity's sake, the DM is free to assume that Emrys gives the order to surrender as soon as the pirate says that the crew will be captured instead of summarily executed/tortured and advance the scene accordingly.

Sayyida is hauled up by a few pirates (and Areleo as well if he isn't still hiding). Weapons are, unfortunately, confiscated (don't worry, you'll get them back for the fight with Black Bart). Yevelda... is quickly welcomed back as soon as she is recognized. She gives you all a few reassuring glances, but you can tell that she is a little bit worried.
After the ship is plundered, the cook recovered from where he was hiding in a breadbox, and everyone accounted for, the commander of the flagship boards to speak with the lot of you. He appears to be a tall, middle-aged human... though something in his eyes doesn't look quite right. Otherworldly, even.
The man is flanked by two more of the deathlocks... the pungent odor of rotting flesh fills the air around them.
"Gentlemen... and ladies as well this time, I see... it isn't often that we get to experience a fight like that. Shame about all the men who died today... but we all know it be the way o' the sea. Name is Commander Richards... formerly Captain Richards... an' it's always an honor to meet a worthy foe. Now see... I'll lay it out straight for ye', I represent none other than the great Cap'ain Hailstorm, an' after seein' you blokes in action... I think that there may well be a place for ye among the same crew. An' I think it would be a mite better option than a long walk off a short plank, don't ye agree?"
You all get the distinct sense that Commander Richards isn't quite in his right mind... as he speaks, he makes subtle, jerky movements, and he seems to look past you rather than at you when he's speaking. It's almost as if he's looking at things that no one else can see... things that frighten him, judging by the large beads of sweat that glisten on his brow and the slight stutter in his voice.

Using the helm of telepathy, Sae can tell that the man's surface thoughts are... disjointed, to say the least. Most of what you can make sense of is that he's worried that some mysterious 'master' might be displeased at how many men were lost.
Eye for Detail - The main clue that you get from looking at the man's eyes is that he likely made a pact with a powerful, and dangerous, otherworldly entity. But it seems that he got a bit more than he bargained for... the undead mages are probably a bit of ominous foreshadowing to his fate should he fail to appease his patron...

“Everyone, lay down your weapons!” He shouted as soon as the pirate’s answer came. Everything was going accord to the plan. So much so that the halfling could not help but to want to smile – it was a reaction he often had after a successful negotiation. He, of course, knew better than to do that. Maybe honest trade and piracy are not that different.
As the flagship commander boards Emrys paid special attention to him. Maybe it was the aftereffect of the battle and the wounds it left but Goldenleaf couldn’t think of much when looking at the man. Focus, the warlock said with the voice of his mind, taking note of his role. He decided it was a good sign that Yevelda was received without trouble despite her efforts resisting the other buccaneers.
“Not even glorified, Commander. We were literally hired to be just a delivery crew and considering our surrender I believe to talk for everyone when I say that we would rather stay alive.” He states matter of factly. “Given the choice we would guess the majority would like to be left adrift, since the closest port is not that far. But if that is not possible, service does sound a lot better than plank.”Please do not agree to let us go, Emrys prayed. “Those are Arleo, Sae, William, Harold,Xorich, ‘Naut and Sayyida.” He continued pointing to each individual as he named them. “Sayyida is a strong hand but doesn’t speak much.” Not to pirates, but that part was better left unsaid. "Xoric can’t do battle to save his life, but is quite the cook. The humans are brothers, and I was the merchant in charge, Emrys.”

The commander lets out a laugh that sounds strangely forced, perhaps even physically painful, as it escapes his throat.
"As temptin' as it is, I can't in good conscience send ye to brave the seas in a dingy, now can I?" he says with a smile that does not reach his eyes. "At least... not when we're a bit short-handed after the moment, thanks to you lot. No... seems to me that it would be much better for everyone involved to have you lot face the trial and join the crew... For a gang like you, I suspect the trial will be little more 'an a formality anyhow."
He will not expand further upon what 'the trial' entails, but you can extrapolate that he is likely referring to the fight with Black Bart that Yevelda already told you about.
"Alright men..." he calls out to the pirates. "Get the tow ropes; this 'ere is a nice little ship. I think that the Cap'ain can make some good use of it."
