Sinjin quickly cast the cantrip move earth, pulling up a loaf of dirt 5 square feet in diameter and 4ft deep. The gnome piles up the dirt evenly ouside of the hole before getting into it for cover. It had enough room for another of the small party members to get in. He ducked down into his little trench to shield himself from any arrow attacks.
"We're all poor as dirt! You shouldnt waste your time on us." He called out to the robbers.
Ooc: on tordals thought, if we want to try and “seize the initiative if you will.” How’s that work? I imagine since they got the jump on us they have arrows knocked and can do reaction attacks if we make the slightest movement. Can I do a sort of stealth check to get myself prepared to do a move and attack and get into the fray?
Ooc: they got the drop in you. Pretty much anything you do will take us to initiative aside from surrender or perhaps, very sneaky casting, or hidden action
On seeing Oslamir step up to the challenge, Vail charges ahead and draws the long sword at his side at the same time. He doesn’t know anything about magic and is perhaps unsure of the spell. He picks one enemy out of the group of three directly ahead of him and hopes he can close the distance before being cut down with arrows.
ooc: his shield is still slung on his back.
also prepared to do any necessary initiative checks or adjust course if I’m out of order.
Rhogar readies his shield and warhammer. He takes a defensive position between the thieves and the rest of his party. Rhogar roars, trying to ge the attention of what might be 2 thieves hidden among the wood line.
He tries to see exactly who is in the wood line. (Perception?) ( any identifying markings or a leader)
Sinjin turns to the side where Rhogar was facing. He sat safely in his bunker, fire cantrip prepared for anyone who pokes their head out. "I've got your back my scaley friend!" Sinjin announced and watched attentively.

Ooc- how loose is the dirt around the party?
Oh and yes there is cover. Its an old growth forest of mixed hardwoods. Fairly sizeable trees and not much underbrush.

Ooc: did my perception check say anything about the distance from the party?
as I understand tauriel is 25 feet ahead of the group hanging from a tree
In the meantime, Vail nods to Rhogar. Through his bleary hungover vision he notices 5 individuals behind cover.
”are you ready dragon? I think we can take them. I say instead of giving them coin we give them steel instead. I’m counting 5 ahead of us.”
You're not entirely sure of distance but the noises you hear sound between 20 and 50 feet.

OOC - Can we cast cantrips before combat or do we have to wait for the initiative roll since we do not get a surprise phase here?
We are not in initiative yet so you're free to act however youd like

Vail is incredibly reckless.

Tordal rubs his holy symbol and the ground around them begins to tremor (casting thaumaturgy )
This is your last chance to let us free before your actions are no longer forgivable.
“Tordal as soon as you are ready my brother, Ill charge at the same time.”
OOC: So sorry I wasn't on today, fellas! Had some homework that I needed to get done and then I hung out with a few friends.
Oslamir decides to take action and hopefully get in a quick spell before they can attack...
Attack: Cast Sleep targeting the area in the trees where Vail indicated, trying to include as many targets as possible within the spell area of effect
Hit points put to sleep: 22
Move: Try to move to any cover if possible
