Generally, magic items that can cast spells don't expend any of the user’s spell slots.
Spells: Some magic items allow the user to cast a spell from the item, often by expending charges from it. The spell is cast at the lowest possible spell and caster level, doesn’t expend any of the user’s spell slots

Yeah; usually magic items that are used to cast spells will give the spell DC and/or attack bonus and only cast at the lowest level. Some items will indicate otherwise for level, and some will also allow you to spend spell slots to cast spells they give you, at which point I believe you get to use your caster DC. But both need to be specifically spelled out in the item.
