It's currently not possible to submit anything with licensed spells (anything outside of the basic rules) for no apparent reason, even if you own the digital copy. My recommendation is that you remove the offending spells from the "Additional Specific Spells" section of your subclass, and keep track of them separately. That will at least allow you to submit the build and its class features.
I'm confused. Homebrew or official subclasses? In your homebrew collection you can keep as many copies of a private subclass as you'd like. Official subclasses can be copied by creating a new subclass, using an official subclass as a template, then leaving everything alone.
If you're referring to published subclasses, if you add them to your collection, then make a copy, the copy won't change with new versions.
