This is a systemic issue with the D&D Beyond homebrew builder, not a single spell problem.
When creating a homebrew background and using Additional Spell Lists, the system does not respect 2024 (5.5) spell selections and instead resolves them to legacy 2014 spell entries.
Repro steps:
Create a homebrew background
Add an Additional Spell List
Select spells using the 5.5 / 2024 rules filter
Save and view the background
Result:
Many (or all) spells resolve to Legacy / 2014 versions
Even when selecting different entries (5e vs 5.5), they collapse into the same legacy record
Spell links open the 2014 Basic Rules or legacy source page
This is not just cosmetic — some spells have material rule differences between 2014 and 2024
Impact:
Makes it impossible to correctly build 2024-compatible homebrew backgrounds
Breaks backgrounds that are meant to expand spell lists using current rules
Forces creators to either:
accept incorrect spell behaviour
or abandon automation entirely
Key point:
This is not about one spell (e.g. Conjure Minor Elementals). This affects multiple spells across the system.
The homebrew tool is currently:
Not aligned with the 2024 ruleset it is supposed to support
Expected behaviour
The builder should:
Respect 2024 spell selections
Link to the correct spell version
Not collapse different rule versions into legacy entries
Actual behaviour
The builder:
Pulls from legacy datasets
Ignores the 5.5 filter in practice
Resolves to 2014 spell records
Request
Please update the homebrew system so that:
2024 spell versions are fully available in Additional Spell Lists
Spell version selection is respected and preserved
Legacy and 2024 spells are properly separated in the builder

Right now, D&D Beyond supports 2024 rules in character creation, but homebrew tools are not keeping up, which blocks correct content creation.
This needs to be addressed for homebrew to function properly with the current ruleset.
The Additional Spell List can only be verified on the character sheet itself. Is the character able to select the ones from that list when preparing their spells?
I can't add Unseen Servant to the edit spell list option. You are only allowed to select from the list they show you.
As shown below, you can't add the the tagging. Those spells are all 5e, despite selecting from the 5.5 section. CME is there twice they are selected from the 5e and 5.5 section but show the same spell in the description.
In the next images I have added the correct tagging, but I still need the spell list section to work correctly.

Did you tag your spell selections properly?
Because there is a small difference in tagging spells that might have led to this.
