So with the necromancer being able to gain life back from killing a creature with a spell of first level or higher: x2 the spell level or x3 if it's from the school of necromancy. Will you gain life if one of your skeletons, zombies or ghouls kills a creature that is not undead or a construct, as it still is a spell that gives these undead life?
No, because the spell creates creatures that kills other creatures, the initial casting of the spell doesn't kill the creatures, the spell just creates creatures that aren't spells.

Yes, but it gets broken if you let the zombies or skeletons heal you anytime they kill some creature, especially since they exist forever.
The skeletons and zombies can be destroyed. It would make a decent distraction away from the necromancer and the chances of them killing anything is low unless they are ravaging a town which would make it even better =)
by itself the necromancer using a lvl 5 spell to kill something will only get 10-15 hp. At CR 9 that's not that much if he has to score a kill on the party.
