Not being surprised doesn't mean you see them, it means you don't loose your action during a surprise round. A good stealth roll still means you don't see them.
Zachary is a contractor hired by the Corvallis senate to help with this supposed interrogation. They have no wish to depend on any of the parties involved in this dispute.

Just to clarify... The PPA is at war with most of the Willamette Valley but Corvallis has been neutral. Representatives of the MacKenzies, Bearkillers, Mount Angel and Yachats (plus others) are here to talk them into joining against the PPA as war is brewing. Lady Sandra is here representing the PPA to talk them in on their side or at least stay neutral. The burned man is a Knight of the Association caught on Mackenzie lands in breach of the cease fire. There is hope that questioning him here will convince Corvallis that the PPA cannot be trusted and they will join in the coming war. So its not a "trial' as such.
Lady Sandra gives an excellent speech about how one of her vassals was kidnapped by the Dúnedain Rangers, a group of crazy bandits. There was an attempt to rescue him where one of the brave rescuers was murdered and during the struggle a fire broke out burning the innocent Knight. (This is politics and at this she is level 20)
You seriously need to read this or you will have no idea whats going on. In the post about I named 10 different groups and people. plus a major political conflict. None of which will mean anything to those who haven't read the novels or at least the wiki.
This is official from WotC. So you don't know if someone makes their save unless the spell specifically says you do. In this case "You know whether each creature succeeds or fails on its saving throw"
OCC I would like to back up a bit. We were to keep the fact the the man survived a secret. Certainly we; or at least Aleister would strenuously object - even throw a temper tantrum - would not allow any PPA people access to our 'witness'; no way Jose! He is in no condition to receive visitors, as one might hear in an ICU. Need to know, Not for foreign distribution, Q clearance access only (and I am not sure any of us have that). Letting Sandra get her mental claws into him would be just plain stupid. Asking around for burn medicine, like aloe, can be explained as Aleister needing it for himself and Max who suffered burns attempting, but sadly failing, to save that poor unfortunate. Just the people upstairs would know, for certain, that he lived.

He has what seems to be a shotgun(?) hanging under his right arm, and has a rapier and short sword on two balderics that cross his chest. His clothing is dyed the muted tones of earth and forest.
"There is a madman running the Portland Protective Association, thinks he's Sauron's little finger or something; anyway, their symbol is a 'lidless eye': Go figure. Too, there is another group of yahoos, the CUT, 'church of the universal truth' of some such pig dung, no offense to pigs, their involved in this brouhaha somehow. Not quite sure about the details on that score, but I am sure it is mostly serving their own purposes, using anybody or anything that comes to hand. They have infested the Montana Marches." He gives a shrug. "There is a whole bunch of other scumbags out to save the world by imprisoning everyone else to do their bidding, for whatever crazy, or mad, scheme happens to be rotting their brains at a particular moment." He grins broadly, "Then there is us, we," he makes a broad sweeping gesture. "We are the good guys, clad in rusted armour, ha! ha! ha!" His guffawing comes from his belly and sounds sincere. "Then there are the Eaters, completely freaked out folks who think other folks are the best thing since sliced bread, you can tell them from their stink, human vermin, but not to be taken lightly. And that is just what we know about here in the Northwest, I am sure that the other parts of the world are pretty much in the same sort of situation, with the possible exception of CUT; those weirdos are just that, weird." He grunts as he looks at the burns on his arms. "I am sure there is more you can learn but that would be the gist of things. You are certainly free to ask around."

Fireball - Drawing magic from your inner reserves, you unleash a devastating nuke that explodes in a circle, hitting multiple enemies, and burning them to a crisp with a godly amount of 8d6 fire damage. Make your DM’s fights look like garbage. It’s also a nice way of TPK your entire party and have them triggered at you for the rest of the week.

But the entire point of having the captive is to have him testify in front of the meeting. Without that happening he becomes totally irrelevant. The entire purpose of everything is to convince the Corvallis Senate to join the Allies in the war against the PPA. You can't keep him away from Lady Sandra because there are factions in the Senate who lean towards the PPA and they won't agree to exclude her.
The Church based in Portland has clerics who can cast plus the PPA has more resources than any other group, so if his health actually matters Sandra can make the case "give him back".
