I would say the lich would not. They are connected to it, but they don't always know where it is. Think of it like horcruxes from Harry Potter. Voldemort couldn't tell where his horcruxes were, but the horcruxes themselves could have a negative impact on anyone who was near them for an extended period of time.
A long time ago, TSR outlined how a Lich could come to be. If that's still the standard, a Lich who has done all the footwork - meticulous research and preparation - and managed to forget to protect the phylactery deserves whatever it gets.
The gap is the whole regeneration process. I suppose that's up to DM discretion (as is how and why a Lich might lose track of the phylactery).
I like to think that keeping a phylactery secure is all part of lichdom - the onus on the Lich to keep it secure, not some innate ability. A stupid Lich is a dead Lich in short order. A crafty Lich can be effectively immortal.
