If you can only publish one, and the only difference between them is how you added the spells, then my guess is the reason one of them is unpublishable is because of how you added the spells.

But they are added the same way an Aberrant Mind Sorcerer adds their spells, its the only way to add the spells so they are extra spells rather than some the Sorcerer has to pick when gaining more spells

Yes, that is correct. When adding spells to that kind of thing, the homebrewer won't let you publish if any of the spells are from licensed books. Go to the Homebrew FAQ, General Homebrew FAQ & Basic Troubleshooting #Ω.
Also, remember that you don't have to publish your homebrew for it to work for your characters or the characters of anybody you're in a campaign with.

I suppose it doesn't take issue if you add the spells in the expanded spell list thingey.

One says i have licensed or private material in it, but the only difference in them is how i added the spells
in the publishable the spells are added as additional spell list.
in the unpubliashable the spells are added as spells
Publishable:

Unpublishable:

If any of the spells aren't SRD, that'd be the issue.
