ok what about this: if anyone has the lucky feat, they inform the person they are fighting, in which case, the person will say weither or not they are going to use an attack, in which case, the person with lucky, can say if they wish to use the feat (just an idea)

In this case, it wouldn't be used before an attack, but after the attack roll, possibly before damage if that's how you want to play it. However, this wouldn't change anything according to the rules it would just make combat highly inneficiant. Another alternative is to just assume the other party (If they say they have the feat) will always reroll crits.

So, I believe you are doing the same as I just did, so I feel like we can clear up any confusion. It looks like my attack still hits, so if you could take STR saving throw and the damage it would be back to you.
