He was stabbed, with an intermediate length blade, consistent with being attacked by an opponent armed with a short sword. The depth and location of the wound would clearly indicate that the assailant engaged their victim with lethal intent.

Objection! Your honor, the prosecuted is not proficient in short swords, and thus would leave ample warning for the victim to escape or strike back, meaning he could not have stabbed the victim!

Your honor. The victim did escape. Otherwise we'd be getting his testimony via Speak with Dead.

Also when I was attacked I was concentrating on a spell and didn't hear him coming until it was sadly too late.
