Choose a spell of 2nd level or lower, that you or another can cast that has a casting time of 1 action, and that can has a range of touch. You or another cast that spell--called the contained spell--as part of casting Spelltouch, expending spell slots for both, but the contained spell doesn't come into effect. Instead, it takes effect when any creature (other than the caster of the Spelltouch) that is not expressly exempted (by race, by person or by target selection of a single race), touches the item. Once activated, both spells are expended (this is also the end result of a successful dispel magic); otherwise the Spelltouch fades after 24 hours, taking the contained spell with it. An item may only contain up to one casting of Spelltouch, unless the item is already enchanted (allowing 1 casting per caster level). An enchanted item having multiple castings of Spelltouch has a 5% chance per Spelltouch, above the first, of its magic being destroyed by the activation of the combined spells. Treat this as a dispel at the combined-spell-slot cost level of application but it disrupts the magic from within the item causing it to be permanent.
Casting this spell using a spell slot of 4th level allows the duration to be extended until activated or dispelled (and a dispel releases the contained spell) and allows a 3rd level or lower spell to be used. For each slot above 4th the spell contained may be of another level higher and at 5th level the range requirement of touch is removed (note: the contained spell still targets the one that touches the item but now a fireball could be contained).
Notes: The contained spell cannot be from any magic item (including scrolls - it must be cast).
