From the support thread, intended behavior: "Characters that select a 2014 class will be able to see and access both 2014 and 2024 versions of every spell that was updated in the 2024 Player's Handbook. Characters that select a 2024 class will only see the updated versions of the 2024 spell (as well as spells from other source materials)."
I've noticed that legacy spells from something OTHER than the 2014 basic rules / PHB (such as from Tasha's Cauldron of Everything) show up as Legacy spells for a 2024 class. Per the above post this *appears* to be unintended behavior. (Though I have no idea why they decided to by-design arbitrarily limit 2024 classes from accessing Legacy spells.)
Unfortunately the only currently supported way to address this is the method originally suggested in the now-deprecated changelog - homebrew your own copy of the legacy spell you want to use. In this case you'll need to tag it with the 2024 class, not the 2014 "legacy" class, to see it in your spell list on a 2024 class character.

Has to do with tagging. Compare Find Familiar to Find Familiar. The first Find Familiar is the 5.5 version and its available classes list Wizard and Wizard whereas the second one, the 5.0 version, just lists Wizard. Because the 5.5 FF isn't listing Wizard twice just for kicks. It's listing Wizard (2014) and Wizard (2024) whereas the other wizard is just listing Wizard (2014).
Mind Sliver (legacy) appears to be tagged with both versions of the classes. My guess is that they thought, "Tasha's needs to be usable with 5.5 characters. So let's go through all of those spells adding the new tags to their available classes." And then they missed that there were some in Tasha's that were getting legacy'd. Similiarly Charm Monster also appears to have gotten the same treatment, being in Xanathar's.
Odds are they did a series of queries to the database along the lines of UPDATE (all spells from Tasha's / Xanathar's) WHERE (has 2014-CLASS) SET (add 2024-class); //my SQL is a little off, but you get the gist
Now Produce Flame and Produce Flame doesn't seem to have that same issue, where Absorb Elements did have the extra tags added. But in addition to being from the Elemental Evil companion, Absorb Elements is also in Xanathar's. Whereas Produce Flame appears is neither Tasha's nor Xanathar's.
Given the changes they made to implementation of spells so close to launch, I can see where this issue slipped in.
TL;DR: They likely did a mass "Add 5.5 to Tasha's and Xanathar's spells" and forgot some of those where getting legacy'd.
