I’m looking at the Druid Wild shape stuff, and at lvl 2 you gain the ability. And there’s only a few creature now I’m fine with that.
But the only thing I’m confused by is if the Druid transforms into a Hawk would they be able to fly just at lvl 2 or would you need to be at a higher lvl?
The description of Wild Shape specifies that beasts with swimming or flying speed are not available at 2nd level. Swimming is gained at lvl 4 and flying is gained at 8. So no Hawk at 2.

Yes, even out of combat. The duration of the ability lasts longer than most 5e combats, so the design of the feature clearly describes the use of the power in all situations, in or out of combat.
