The policy so far has been that it's ok to homebrew and publish content from previous editions of D&D, as long as Wizards of the Coast hasn't published that content for 5e themselves.
As an example, Otiluke’s Resilient Sphere is in the 5e Player's Handbook, so it would not be ok to publish your own conversion.
Some spells have changed names also, so "Rock to Mud" no longer exists - it's Transmute Rock.
You're also not allowed to use any copyrighted Wizards of the Coast names, such as Mordenkainen, Bigby, Tenser etc.
