It's not a scam; its a separate company, not part of Wizards of the Coast (the publisher of the books). D&D Beyond licenses the material from WotC and creates the tools that you use, including the databases, character creators, encounter builders, etc...
Tool not scam. D&D books are like hammer and nails. D&D Beyond is like a nailgun. Both allow enable you to build the game. D&D Beyond can make some of the job easier/faster. But owning a hammer and nails does not entitle you to a free nailgun. Tool not scam.
It's currently in Mordenkainen Presents: Monsters of the Multiverse. It costs $1.99 to purchase the individual race. Alternatively, if you own the physical book (or I suppose, if you own it on another site like Roll20), you are explicitly permitted to homebrew build it on DDB - you're just not allowed to publish it. It's for personal use only.

The tabaxi is in Volo's guide to monsters and requires purchase on DDB (or having it shared to you). Does this link send you to the marketplace?

If not, it may be shared to you. In that case make sure to build your character in the campaign with content sharing.
