Reading the Psionic spell table in the AM sorcerer, it says this:
Whenever you gain a sorcerer level, you can replace one spell you gained from this feature with another spell of the same level. The new spell must be a divination or an enchantment spell from the sorcerer, warlock, or wizard spell list.
Given that text, is there any reason you couldn't replace a spell immediately upon gaining it? Like, at 3rd level when you get calm emotions and detect thoughts, could you instead take tasha's mind whip and detect thoughts? Or do you have to actually take both of the spells listed and then you can replace one at a later level increase?

Yes, you can absolutely do this. The only level where it's at all questionable is if you're character level 1 - that is, it's your very first level in any class and that level is in aberrant mind sorcerer. In that case, it's not at all clear that you gained your first level. However, character levels 2-20 are unambiguously "gained".
Related to this, does anyone know how to do it in D&D beyond, or at least a work around?
