In the character builder, I cannot use the critical role gunslinger with the 2024 fighter, as it doesn't appear as a subclass in the drop-down menu. I do have critical role content enabled, I'm guessing it's just an oversight with the new class.
No, it’s because Critical Role is third party content. I’d say the odds of it ever getting updated and included are slim as Mercer and Co. are transitioning into their own system.

not all the subclasses are updated tho. you can use all of the non-updated ones on the 2024 classes
I created a new version of the Gunslinger and still can't pick it on Fighter. New fighter won't let me pick any subclass from any source but core and Tasha's/Xant. Nothing else, so no Echo Knight, No Gunslinger

Assuming you've got homebrew turned on for the character, your problem is probably that old Fighter and new Fighter are, for DDB purposes, different classes, and a subclass can only belong to one class. Making a variation on the official subclass won't change which class it's pinned to.
To homebrew gunslinger for new fighter, you'll need to make a new-fighter subclass, and copy over the gunslinger stuff.

I was on 2024 because unfortunately dm is only letting us use 2024 rules because he says "the 2014 rules were crap WotC wouldn't make 2024 rules if they didn't want us to play it"

Tell him two things.
1. The 2014 races/classes are compatible with the new rules per the 2024 rules.
2. They put out new rules because they are a company that sells books and are trying to sell all of us another set.

I mean, nothing wrong with the DM wanting to run new rules. Yeah, homebrew is your best option. Luckily for you, only one feature has options, and it's only 8 of them. So it's not as bad as three of the six Grim Hollow Player Pack subclasses...
yea thats fair when i dm i just prefer 2014 rules because they have all the features without anything needing updating, but i understand why alot of dms use 2024 rules

To be fair, all official subclasses are available on the 2024 set (even if Shepherd Druid is currently broken because of the way summons work now). You're using a third-party subclass which was never well thought-out by its creators in the first place.
I'm running an old 2014 workup for my gunslinger traits and another 2024 mocked up under battle master as the classes are very similar and using the paper character sheet to "hybridize" the two. My dm is also super cool working out some redundancy created by the rule updates and keeping the subclass balanced to new content using other classes for reference. For example were giving gunslinger the same grit points as he would have superiority die, no extra damage from grit still since firearms slap. Also altering the action economy of the level 7 feat to still give a bonus, etc. Were not having to get super creative to make this work in this way and should only need to make minor adjustments going forward, hope it helps. Might even work with other 3rd party subclasses

All third-party subclasses are currently unavailable for the new classes. It's likely a licensing issue.

Make sure that on the Home Tab of the Character Builder you have Critical Role Content enabled.

When selecting your class, did you scroll down past the 2024 fighter and select the 2014 fighter instead?

Critical Role has yet to provide a version for the 2024 class. It works only on the 2014 one.
As a workaround, you could make a homebrew copy of the 2014 subclass to see exactly how it was set up, and then rebuild it on a blank 2024 subclass.
