I have a few homebrew items that, while they pass the automated check, I'm not 100% sure would pass a moderator check. I don't want to incur a penalty for publishing them so is there a way to throw these to a mod for review?

If you're not sure whether something meets the rules & guidelines, you can always PM a moderator to raise your concern, providing links to the homebrew in question.
If your question is about balance or use of modifiers etc, then it's better to post on the forums and ask the community - there's a good chance a moderator will also see that.

Arbitrary, ad-hoc approaches are what mandated the need for an automated system in the first place. Maybe a policy or some guidelines for this could be in order?

You're going to have to be clearer about what you're asking about a review for.
If you feel that the Homebrew Rules & Guidelines aren't sufficiently clear, then that's something you can ask for clarification on in this post.
If you think that publishing your homebrew might incur formal penalty, then that's probably a good indication that you shouldn't publish it.

No, there is not a way to submit your homebrew for manual moderation.
The automated moderator now handles all submissions. A moderator only becomes involved under the following circumstances:
