so I've been thinking about sentient magic items and the spell Dispel Magic, my query is what is actually keeping the soul or consciousness inside the magic item and how would it be taken out. would love to here some good answers.

Magic.
Sentient magic items can be formed by any number of ways. Some are formed when a living creature uses a weapon and through pure emotional circumstances part or all of them becomes stuck inside the weapon. In other cases they were trapped there by some dark wizard. Some are purely artificial lifeforces created through alchemy, ritual or from a god (in Forgotten Realms the Raven Queen made many). Some are weapons that have seen such battles of good or evil (defeating untold thousands of evil beings or a thousand years in the hands of evil slaying innocent people) that they awaken and gain their sentience.
And some could be a result of a mishap with True Polymorph.
As for Dispel Magic, most of the time it doesn't work on sentient magic items (or magic items in general). The Dispel Magic can only end a non-instantaneous Spell. Not all magic is from spells. Most magic items are what they are from something far beyond a spell, and others could be from an instantaneous spell (thus cannot be dispelled). Not all sentient magic items were ever creatures and lack a real soul.
So the question is: what is the sentient magic item and how did it become so? The story is unique to that item and that story will determine if it can be dispelled/freed/etc. Even ones that cannot be dispelled might be undone/freed by some other means which you/the DM can create.
