When building an encounter, I prefer to calculate xp like mentioned in the DMG. If we'd take two Aboleths for instance, with 5900 xp each that would calculate to:
(5900+5900)*1.5=17700 xp.
I've made a table calculating the easy to deadly xp values for encounters, which tells me that that amount of xp for a party of 4 is Deadly at lvl 12, Hard at lvl 15/16, Medium at lvl 18 and never gets easy (past lvl 20). For a party of 5 it is Deadly at lvl 11, Hard at lvl 13, Medium at lvl 16/17 and also doesn't get Easy (past lvl 20 maybe).
So that makes sense I guess :P
It's not a flawless technique, because if the party has particular high Wisdom saves or immune to charmed condition this makes the fight easier, whereas if the party is weak on those areas this greatly increases difficulty.
How smart are the players, what magical gear have they got, do the monsters have weaknesses the PCs can exploit, are the monsters in their lair, what are the 'victory conditions', how far are the PCs willing to go to secure victory?
So yes, a straightforward question, but a far more complex answer.
The answer is of course level 1.
They might get eaten, but they can at least try.

A legendary creature can have any CR. Are you asking about legendary creatures in official books specifically?
