The general rules on casting spells from items say that the spell is cast at its base level unless the item description says otherwise, and the item description for a Spell Scroll does not say otherwise.

I'm not sure if the question was about crafting or finding a spell scroll in your adventures, but assuming it's about crafting, just to add that spells cast from a homemade scroll use the spell save DC and attack bonus of the crafter. Not relevant for Conjure Minor Elementals, though.
Also, I'd say it's possible to craft an Xth-level Spell Scroll by casting the spell at level X each day of the inscription.
To scribe a scroll, you must have proficiency in the Arcana skill or with Calligrapher’s Supplies and have the spell prepared on each day of the inscription. You must also have at hand any Material components required by the spell; if the spell consumes its Material components, they are consumed only when you complete the scroll. The scroll’s spell uses your spell save DC and spell attack bonus.
I don't know if I agree with that last part — it doesn't say that you're actually casting the spell each day when you're crafting the scroll, just that you have to have it prepared. It doesn't make any mention of using a spell slot at any point in the process, and you have to actually use a spell slot to upcast something.

All of that said — from the perspective of a DM I do not think it would be a huge deal to house-rule the existence of upcast spell scrolls, or to allow people to craft them in the manner TarodNet was suggesting.
