I'm not sure if the question was about crafting or finding a spell scroll in your adventures, but assuming it's about crafting, just to add that spells cast from a homemade scroll use the spell save DC and attack bonus of the crafter. Not relevant for Conjure Minor Elementals, though.
Also, I'd say it's possible to craft an Xth-level Spell Scroll by casting the spell at level X each day of the inscription.
To scribe a scroll, you must have proficiency in the Arcana skill or with Calligrapher’s Supplies and have the spell prepared on each day of the inscription. You must also have at hand any Material components required by the spell; if the spell consumes its Material components, they are consumed only when you complete the scroll. The scroll’s spell uses your spell save DC and spell attack bonus.
I don't know if I agree with that last part — it doesn't say that you're actually casting the spell each day when you're crafting the scroll, just that you have to have it prepared. It doesn't make any mention of using a spell slot at any point in the process, and you have to actually use a spell slot to upcast something.

All of that said — from the perspective of a DM I do not think it would be a huge deal to house-rule the existence of upcast spell scrolls, or to allow people to craft them in the manner TarodNet was suggesting.

While that spell is, in general, eligible for use in that item, there's a general rule about magic items in the Dungeon Master's Guide that says that when a spell is cast from a magic item it is "cast at the lowest possible spell and caster level". This would mean that an Enspelled Weapon would always be casting that particular spell at 4th level.
It's important to remember that "upcasting" is an unofficial term used by the community. The actual concept within the rules is casting "with a higher level spell slot", and so you have to actually use a higher level spell slot to get those benefits. They generally don't apply when you cast a spell without using a spell slot at all.
You are not including the entire quote, so your information is misleading. You can, in fact, have an enspelled weapon cast a spell at a higher level.

RAW allow for the DM to create a weapon with a higher level spell. The DM is the author of the item's description and I think it wouldn't make very much sense to limit spells on weapons in this manner, especially when you consider that casting spells at a higher level most often results in lower damage output anyway.
