Both of those questions are entirely subjective, and have the exact same answer: ask your DM.

You don't know what fear is until you've witnessed a drunk bird divebombing you while carrying a screaming Kobold throwing fire anywhere and everywhere.
Now, that said regarding the when, the DMG suggests Very Rare items wait until about level 11, and the Staff of Frost can pretty well trivialize at least one encounter a day at 4th level. Wouldn't bank on getting it soon.
Up to your DM, i often give very rare magic items to characters before level 11 but i wouldn't give a Staff of Frost before level 9, which is the level most of those spells would normally be castable.
