this is something that we discussed in some depth actually.
Homebrew content created by others. You may not add public homebrew, that has been created by other people, to D&D beyond, unless you have their permission to do so (e.g. content from other websites).
Every piece of homebrew that a user publishes has to go through moderation first and it's a manual moderation process, where the moderators do their best to check each submission doesn't break the rules.
If we're aware that a submission is work that is available on another site, we'll reject it on that basis, or contact the submitter to request they evidence that they are the content owner (depends on circumstance).
We can't guarantee that we'll catch everything and I am pretty sure we won't.
So the fallback is reporting.
If someone spots homebrew content on D&D Beyond that they don't believe should be there, they can make a report and a moderator will review the content. If it is a match for content taken from another site, then we'll remove it from public view.
Along a similar line to that asked by JJ_Ellis, what happens if two people develop very similar pieces of homebrew separately, as what happened with Calculus, and try and publish them?

in that case, as long as both homebrew submissions adhered to the homebrew rules & guidelines, they would both be accepted.
We have a team of moderators who are responsible for keeping the forums in order and homebrew moderation, so there's a good chance that each of those homebrew submissions would be reviewed by a different moderator, with no knowledge of the other homebrew.
Homebrew magic items I see can contain spells (I recently created a ring of the cant homebrew item that allows wearer to cast disguise self and message spells) which was approved but then I went to create a new version of the ring with disguise self and a homebrew spell whispering wind (which I also created that was approved as a homebrew spell) it does not appear in the spell list to select. So homebrew spells cannot be used in homebrew items or I am missing something or the spell was so newly approved it just didn't appear in the dropdown spell list yet when I went to make a new version of the ring???

Q: Will I be able to homebrew RACES/SUBRACES or CLASS? A: For now, homebrew is limited to Monsters, Spells & Magical Items. The staff development team are continuing to work to bring more content and tools to D&D Beyond and expansion of Homebrew is part of that. It has been confirmed that Races & Sub-classes will be included in the future.

It will be one of the improvements being made after launch - I don't have a date.
Staff have also confirmed that there will be a formal mechanism for using Unearthed Arcana playtest rules as well at some point in the future.
I know that this is a fair amount of, "in the future" but the staff are committed to continuing to add features, further increasing the usefulness of D&D Beyond.

So I attached the item and could see the spells attached listed there. That was version 1.1 of the item I corrected my mistake in version 2.0 of the time with the spells also listed in the description and resubmitted for approval which i am has yet to come through. To me it just wasn't clear the the spells should have been also listed in the description area... live and learn I guess. Thanks for the clarification I have a much better handle on how the homebrew works now and what it can and cannot do.

Think of the description as the information you would see for an item in the DMG, or a spell in the PHB - you need all the information listed there so the DM or the PC is able to use the content. The properties are back of house and are used to make the content integrate and work in certain ways on Beyond. This means that when you have the spells listed on an item in the spells properties section, you'll see them to be used linked to the item on a character sheet for the character that has that item equipped/attuned.
Technically you could ignore all the back of house properties when creating Homebrew, but when the homebrew is added to a character, the item/spell would not integrate properly and have incorrect displays within the character sheet. Once voting/commenting is added for homebrew, creators who have ignored the back of house properties would see less votes for their work (we assume - who knows how people on the interwebz will react).

Quick question: I've created some homebrew spells that are in my campaign, but I did not publish them. Should my players be able to search for them? Neither they nor I could see them using the global search tool. I added them to one of my players' character sheet manually, and he could see it on his sheet. Is there something I am doing wrong?

Private homebrew will not be available in Global Search. You would always have to navigate to those at your homebrew/creations on the site.
Any PC's in your campaign should see them in the list of spells that they can add on their character sheet in the Add Spells option.

Quick question: I've created some homebrew spells that are in my campaign, but I did not publish them. Should my players be able to search for them? Neither they nor I could see them using the global search tool. I added them to one of my players' character sheet manually, and he could see it on his sheet. Is there something I am doing wrong?
