I bought a couple of the 4E books and there are a couple of pretty cool things that don't seem to be present in 5E. Is it ok to add them as a homebrew item or am I going to get deleted and sued?
You're welcomed to duplicate anything in homebrew-form including official 5e items instead of purchasing them on ddb. You just aren't allowed to publish them to the community. (It won't let you publish it since it's a duplicate of an existing item)
There's absolutely nothing stopping you from creating 4e homebrew. When in doubt don't publish it. Chances are you just want to use it personally and between people in your campaign, so ultimately there is no reason to publish it. Anyone in the same campaign module as you can access your homebrew content.

You and players in your campaigns can use your homebrew without you having to publish it.
You can make anything you want as private homebrew, you just can't publish anything that has been licenced.
