You can put the entire PHB into your DDB's homebrew collection if you want, you just can't hit that "publish" button. _You_ can have it, and you can share it via the Master Tier with other DDB users in a campaign with you, it just can't be published to be searched and discovered by community. That's always been the way DDB Homebrew has worked.
I mean, yeah, obviously, my question is whether or not we will be allowed to publish the legacy versions of these races for use by the community at large.
I mean, yeah, it should also be obvious that delisting does not equal abandonment of copyright. I wouldn't be surprised if WotC eventually release these two books on DMsGuild in some form (I could also see a pdf project in the vein of Domains of Delight or the Minsc and Boo book that just republishes the lore). But the same rules apply here as apply to races that had neg modifiers in Volo's till WotC changed course. Or UA etc. So no, this isn't an opportunity for free community generated content to be created out of legacy material.
