Maybe the old Gnomish artefact may have delayed talking because it is shock due to its respect for ceremonies and order. Such an item could give you a voice to respond to the gnome's offences in game. Having this voice speaking may cover a need which the orc and changing might otherwise want to fill.
... So without the gnome feeling remorseful, and coming back to confessed his crimes, I don't see how the changeling and the orc could get any closure, and the party would essentially be broken up. ...
Fine that the gnome faces consequences. Fine also if you also rig things to run any game arc that you want to play.
Within this it may also be fine for the gnome to be presented with options and make informed choices such as to: 1. risk PvP 2. leave and allow the player to bring in a new character 3. get going on some kind of "feeling remorseful" arc
How I would deal with this: allow the players to catch up with the gnome. Forshadow that there is some threat to the region before that. Then, make it life or death-- apparently there are drow warparties scouring the surface. They're looking for something and the players realise that they are in the middle of this searching sweep. Maybe there are a party of drow literally right there and they're if they make too much noise, they'll kill all of the players. So now the players have an ingame reason to cooperate with this gnome who acted a bit too much like a psychopath.
Maybe have the only way to escape the elves is through the underdark. Maybe there is a friendly detizen of the underdark who suggests ducking into the underdark and popping out another tunnel. Then getting them captured is a piece of cake.

To echo what was said above, I don't like strong arming the gnome into turning himself in. It sounds very against their character.
I think you could accomplish the same goal by having the guild capture the gnome, maybe while sleeping, and go for the trial from there.
