My Dm make a Rule that can talk to a monster in combat ( cost 1 action ) and if success roll ( Charm Roll ) can make a monster to ally is that legal or broken the rule ?
The general rule is that you can communicate briefly on your turn and that the DM can require an action if it needs special care or unusual obstacle so its not rule breaking indeed. Rallying an hostile enemy as an action with a Charisma (Persuasion) check is not only legal, it can even save you alot of trouble while making yourself free allies!
Other Activity on Your Turn: Your turn can include a variety of flourishes that require neither your action nor your move.You can communicate however you are able, through brief utterances and gestures, as you take your turn....The DM might require you to use an action for any of these activities when it needs special care or when it presents an unusual obstacle.

I wouldn't expect it to work in every encounter but sometimes negotiation can work quite well.

If you can persuade *any* enemy and that causes them to completely swap sides then it’s a broken rule.
With more nuance, it works.
And action wise, talking is free but specifically making a persuasion check should be an action, yes.
