If I make an attack and the DM says "your arrow flies straight past his head" signifying a miss..... can I then declare I will spend a die and add a D8 for my precision attack?
This seems like a very confusing interpretation of this maneuver. Are you not supposed to have the knowledge that your roll was a miss before deciding to expend the precision attack?
So your DM may have forgotten to ask you about this for you precision attack. You aren't supposed to know that you missed or hit, you need to decide to use your ability before. it's like someone telling a story and you jumping in and going "no, the side character actually lives and kills that dude" or rewinding time to undo what happened just because you know what will happen if you do it differently. You can't do that in real life so that's what we try to do in DND.
I think this is subject to interpretation. The ability says "You can use this maneuver before or after making the attack roll, but before any effects of the attack are applied." Unlike things like advantage or bardic inspiration, it doesn’t say you have to decide before making the roll or knowing the outcome. Probably best to ask your DM how they want to run it.
Also I'd suggest talking to your DM and reminding them that you have this ability and have a discussion about how/when it can be used. It's a good thing to do for any abilities that allows for an additional dice roll at a non-normal step in the process. Because usually if you see a roll you can then jump directly to narrating its effect but with these additional roll abilities a DM might have to change that process a bit.
