I am pretty sure that I have put this out before, but here goes again:
Bottom line up front: I can no longer purchase any further digital products in good faith untill DnD Beyond and or Wizards of the Coast provide a clear answer to the following concern.
What becomes of all of the digital content that the subscribers have Purchased if, for some unforseen reason, DnD Beyond/Wizards of the Coast experiences catastrophic loss due to unrecoverable crash of servers or worse Beyond/WotC goes belly up and shuts down permanantly with zero replacement?
Will we the subscribers: 1 - be provided stand-alone, downloadable type files (ie: .pdf) after the fact somehow? (bad idea as at that point you wont know who owns what); 2 - be provided physical copies at no additional cost after the fact? (again, bad idea as at you wont know who owns what); 3 - be told too bad, so sad leaving all of out hundreds if not thousands of dollars each? (another bad idea that will most likely cost you your entire customer base)
Neither myself nor any of my friends/acquaintences with paid Beyond subscriptions have been able to locate an answer to this question with-in Beyond.
We deserve to know how this answer so that we may make educated decisions for future digital purchases.
What they plan to do has not been stated and is unlikely to ever be stated because they, themselves, don't know until such an event happens. However, they hold the legal right to refer to the Terms of Service everyone accepted to make an account and buy services - which basically boils down "tough luck, bub". And before anyone goes "how evil of them" - this is actually an almost globally agreed standard that has been in place for nigh on two decades. It is the standard for all similar digital access content - and the terms so listed are actually enforced under law. At least for Canada, US, UK, all of Europe, and Australia. Those are the only ones with such consumer legalisations that I have studied. Not that it matters, because any website can hold you to the laws of their base of operations, regardless of where you are, and they are in the US. When you accepted the terms you accepted the laws as applicable to King County, Washington, US.
Anyway, to the terms in question:
1.4 Digital Content License
Basically you don't own the content. Your money provides you a limited license to access the content which they can remove at any time for any reason. They do not need to give you any notice and offer no liability.
Under Additional Terms for Digital Content they again mention that they are not liable for any loss of access to the content for any reason.
Under Termination, 11.2 they detail they can terminate your account including for reasons of removing D&D Beyond as a service. In 11.3 they detail in such an event of termination your license is revoked without compensation or refund or liability owed by them.
