It's a cool item, but honestly, feels a bit weak for a legendary item. The specification that it only works on small creatures and objects is already a massive downside, and not needed for a magic item; you could easily have it pull medium or maybe large creatures into the sword. (although I would draw the line at gargantuan).
The damage of the swallow is also extremely low, with a very easy save DC; a single strike from this with a +4 strength bonus does 23 average damage, and this weapons special use ability does an average of 17.5 damage, over three rounds, IF they fail a DC 13 (relatively easy) save: it is simply not worth using over the weapons normal attack.
I would do one of two things: raise the save to ~16 with a much more deliberating effect OR, keep the save low and the ability weak, but have the save trigger any time you hit with the weapon. Being able to remove things from combat is a powerful ability, but does not justify using an action if the save is so low.
Lastly, I would make the ability do a bit of damage against creatures that are immune to the effect. a bit of a consolation prize, if you will.
TLDR: fun concept, but much to weak to justify being a legendary weapon. Legendary weapons should be game changing, and although the effect of this is interesting, it lacks the power and feel of a legendary weapon. Make it usable against more creatures (not just small) and buff its ability.
