Ok, and your point is? Your DM's opinion doesn't change what the correct answer is.
the DM's opinion IS the rules.
The DM makes table rules based loosely on the structure of the PHB and DMG. its called Table Rules, and is IMO the most enjoyable way to play. obviously RAW is just as acceptable as Table Rules, and there are plenty of players out there that prefer RAW over Table. It is the DM's choice to play RAW or Table, and not every player is compatible with every table.
It is important for you to find a table that suits you.
I don't think I have ever had an instance of level up when the party could not rest.
RAW, your HP max increases but it says nothing about current HP. I suppose if your GM does level up right after combat, your level goes up, your max hp goes up, but you need magic or time to get back lost HP and other resources.
Of course every game can be different and GMs are entitled to do it in a way that they like.
