No, Suffolk is correct. The same wording appears on Sidekicks, if you want precedence. Your first level in a class is gained when you gain it, and leveling happens in an order you choose (that's from Xanathar's, dealing with rendering simul effects sequential). As a result, the new Soul sorcs can do their swaps right at level 1. The only alternative would be requiring them to multiclass, which would be absurd.

That means if we adopted your ruling, only genuinely level 1 characters would be penalized - anyone multiclassing into sorcerer would be able to swap at sorcerer 1, and only pure sorcerers would not be able to at sorcerer 1. That's a bit weird, and a good reason to step back and wonder if something's been misinterpreted.

Here's a different angle from which to look at it; make of this as you will. You don't have the feature at the time you initially "gain" your first level in the class, because you get that feature as part of that level. You have the feature going forward, though, so you can swap out a spell at each level beyond that (i.e. level 2 and following).
As for adding the swapped spells to your character sheet, I don't think there's currently a workaround for it. I know you can add additional proficiencies, languages, etc., but as far as I know there's no way to do the same for spells. I guess we'll just have to write down the swapped spells separately while we wait for D&D Beyond to add the mechanic to the character builder.
This thread walks you through how to do it with homebrew. Only way right now to do it. I had an issue getting it to take, it wasn’t showing, but after waiting a while (I checked it the next morning after I followed the steps) the changes took hold. It’s not optimal but it is a solution until DDB gets it working

The Side Kick creation Rules... Which are in Tasha's. Do not allow for Side kicks to switch out spells at level 1. So bringing them up for that point is incorrect.
Also. Side kicks are not PC's. They are a special kind of NPC/Monster. They are a way to add classes that are in between basic monsters and pc classes to npc's and monsters that primarily would travel with and help out the group. They have their own rules to things and their own class level ups that they follow that do not not necessarily entirely follow those of PC characters. For example when it comes to Casters they all get potent cantrips, empowered spells, and eventually immunity to concentration loss regardless of what kind of caster they are. Which is broken up into subcategories that aren't entirely reflective of PC classes while drawing upon different caster lists that allow for combinations of spells not necessarily allowed by single class PC's and eventually aren't really accomplishable even by multi-class caster pc's.
Edit: Also Please do remember that rules outside of the optional multiplayer section are not written with Multiclassing in mind for the most part. So if they are written in a way that it wouldn't work on a level 1 character of that class. They don't magically give you the power to do them when you add that class on a multiclass. Such as when it comes to replacing spells. whch a normal level 1 Clockwork Sorcerer would not be able to do until level 2.

You can't get AoA until Sorcerer level 2 at the earliest. That might be the issue.
