The limits on spells known through level progression aren’t enforced when making a character at higher levels. Easiest to see in the warlock at 5th level. They can know, at most, two 3rd level spells, one new and one swapped. The selector will let you choose all third level spells if you want.
I think what he is saying is that through a normal leveling up process, a Warlock would only be able to learn a 3rd level spell during levels when they had third level spell slots, which is only when leveling to 5th level. You could not level a warlock to 5 and have more than 2 3rd level spells at that point.
According to the Warlock Table, the Warlock gets to know a total of 6 spells and has 2 spell slots of 3rd level. The character builder does the same.
Bixington is saying a 5th level Warlock can only have at most two 3rd level spells (the new spell they get at that level, and the one spell they can choose to swap out every new level) but the character builder allows picking six 3rd level spells.
I think it would have to be up to the DM to enforce what level spells you could have for creating higher levels, vs leveling up. We are going to have this problem as we about to switch campaigns and the rogue wants to switch to a sorcerer, in between who will start at level 5.
Yes, it fits according to the table but that ignores the limitations imposed by the "Spells Known of 1st Level and Higher" rules. I should have used something other than "create," say building or moving. It doesn't matter if you start in the middle or level up through the tool, it allows you to choose higher level spells when advancing than it perhaps it should.
The Spells Known rule would seem to impose these limits for a warlock, as I read it (apologies if I mess this up):
1st level 2 spell slots=> two (1st level spells)
2nd level 3 spell slots=> three (1st level spells)
3rd level 4 spell slots=> two (1st level spells) and two (2nd level or lower spells)

This currently relies on table enforcement from players/ DMs.
We could possibly introduce restrictions on this front in the future, but any time we do this it also means that we have to allow for overriding that setting for those groups that want to remove those restrictions in their campaigns (which makes it a little more work). We've got it on the list, and we'll see when we can fit it into the roadmap.
