I've recently started creating a homebrew subclass, and on one of the class features I want to add a list of spells which get added to the class spell list upon reaching certain levels. In the Add a Spell modifier for the class feat in particular, a majority of the spells I'm wanting to grant access to are somehow not available to choose.
Namely, these missing spells are:
Resistance, Hex, Wrathful Smite, Life Transference, Staggering Smite, Circle of Power, Mental Prison, and Maddening Darkness
There are more spells as well that I am unable to choose from, but these are the spells in particular I want to add to the homebrew subclass that are missing. Are there any ways to circumvent this issue, or otherwise add them to the class without counting against the number of spells prepared?
It looks like those spells you listed are contained within books like PHB. Have you purchased either those books, or at least the spell bundles from them on this website? If not, that would be why.
Only the spells from the Basic Rules, and the Elemental Evil Players’ Companion are available for free because those are the only ones that the game’s publisher, a company called Wizards of the Coast, has chosen to give away for free.

You can put them on the list, but you won’t be able to learn, prepare, or cast them. Not unless you happen to be in a campaign with Content Sharing enabled and someone else has the book.

Because that modifier draws info from what you own. that maps the information directly to the subclass.
The other way will draw that info from what the players who make characters with this subclass have access to. Instead of directly mapping the spell to the subclass, it just lets the character sheet know which spells to list if they are available for that player. Suppose you Learn/Prepare those spells in that shared content campaign, and then leave that campaign the Character Sheet will recognize that those spells are no longer available and no longer present them as options.
Not to mention, even if you buy yourself access to those spells, it will never let you publish the subclass because you will have mapped content to it that is locked behind the paywall.
