Several years ago, a different company picked up the old TSR trademark (but not IP like D&D 1e and 2e), after WOTC let it expire. That TSR (let’s call it TSR 2) produced Gygax Magazine and Top Secret: New World Order. Recently they accidentally let the trademark registration lapse, and another company (#3) snatched up the trademark, although they said company #2 could continue to use it. Then this newest company (let’s call it TSR-3) got into a huge PR mess because the leadership posted some really nasty things on social media, and that company fell apart, but not before company #2 rebranded to avoid being damaged by the bad PR of #3. None of that, however, changes the answer to your question. WOTC still has control of 1e and 2e material.
The basis of your question is not true. And you're assumptions are incorrect and quite the opposite. One of the reasons WotC maintains PDF editions of all prior editions (including AD&D and 2e) is arguably to maintain its control of those IP. Basically, digitally, not only are the rights being held, but the properties are technically still in production through DMsGuild, the subforum for which this thread really belongs.

You should not publish any content that is not your own original work, public domain or not. That is one of the Homebrew Rules & Guidelines.
If you have to ask, don't publish it, that's the best course of action.
Well this makes sense in the particular context of homebrew creation on this site,public domain exists for a reason, and advicing to not post it is, downright idiotic, and disallowing it more so.
Such a strange thing to say, maybe you need to understand what public domain is and why we have it.
