in a campaign that i am going to be running, one of the co-Dm's (we take turns DM'ing, i take on the main story, while the others do side stories) has created a homebrew item, basically a Devil Fruit from One Piece, and personally i think it is too powerful and game breaking in its functionality. He has made 10 to 20 of these devil fruits, which the player's can get but some he has made for villain use only. to put it all simply, am i being too harsh here, or should i allow this, or should i push back and tell him to change aspects of this?
Any help or advice will be greatly appreciated.
this is the Devil fruit in question:
Gas-Gas Fruit: Can cast poison spray as a Free action after every successful hit the owner of this fruit makes. Anyone the owner of this fruit considers an enemy and is within 300 feet cannot breath. The owner of this fruit also gains an Immunity to poison damage and a vulnerability to bludgeoning damage
Well, I would tell them directly and honestly. First of all, there is no such thing as a “free action” in D&D, so that part would have to become a bonus action or reaction or something which would at least limit that to 1ce/round. As for the enemy creatures within 300 feet not being able to breathe, yeah that’s broken. Just deciding to be hostile to a creature could kill them before they could even get away based on the suffocation rules: (https://www.dndbeyond.com/sources/basic-rules/adventuring#Suffocating). These would be my proposed changes, which you might want to suggest as a way to rebalance the item:

While you have this item attuned and equipped you gain the following benefits:
You have resistance to poison damage.
Whenever you use your action to take the Attack action or cast a cantrip you can cast the poison spray spell as a bonus action with a save DC of 17.
As an action you can emit a cloud of toxic gas that last until the beginning of your next turn. Each creature within 30 feet that is not attuned to a gas-gas fruit and enters the area for the first time on its turn or starts its turn there must succeed at a DC 17 Constitution saving throw or begin suffocating.
