uhhh... almost all of the moderators recommend using Beyond20, and will (rightly) direct people to talk to the Beyond20 devs if there is an issue with Beyond20 that people think is an issue with Beyond. Where are you getting this "against the terms of service" bullshit?

News for you: the EULA of any online service you use lays out terms under which the service can terminate your account for any reason, or no reason at all, and they will owe you nothing for cutting you off. Not even an explanation. They make those documents so long and ridiculously obnoxious specifically so you don't read them and realize that they basically say "we don't actually have to give you anything for your money, we can terminate your account whenever we feel like it, and you can't sue us or join a class-action suit against us. We probably won't do those things, but we totally can so don't act like we didn't warn you."
So Beyond20 is fine. Or at least as fine as anything else people do in good faith. That warnign from the EULA is there basically to let DDB squash anyone trying to build a sub-business off of DDB's stuff, or anyone trying to datamine their customers who isn't them.

Not news, and your logic is bizarre. A mod specifically and recently pointed out that pulling any data from DDB in ANY way is against the terms of use. Perhaps they have had a change in policy, perhaps that is why the Roll20 import/export is no longer working, no idea since I don't use it.
D&D Beyond will not disable or prevent extensions if they do make a VTT. On the contrary, they are planning on releasing a public API so people can incorporate the character sheet into other applications more easily. It's on their longterm roadmap.
API has been on the long term roadmap since 2017. I don't see any incentive to do it unless a particular application comes along that will drive DDB sales.

They might turn a blind eye to scraping if they can't stop it, or if it's one of these things wherein they legally have to say it's banned but they think they'll make more money to let us keep doing it. For example, it might encourage people to buy stuff here as well as (or instead of) Roll 20 if we can scrape our stuff from here to there. If they think lowering the boom on that would lose them customers, they'll hold off.
But they are not going to do anything just for our benefit. Companies don't stay in business that way.

Yup, that destroys the Foundry VTT importer made by VTTA -- This is one more reason to make me stop using D&D Beyond for just about anything. It's not like they have a VTT here... so I have no real choice but to use something like Foundry. I've already given up on using the encounter builder here (I use KFC or Foundry's instead), and the Monster creator (again, Foundry's is superior). The only reason I had left to use this site was the characters. And if I can't import them, then I'm going to have to ask my players to do all their updating/etc in Foundry, because that is what we use to play our game. And I'm not alt-tabbing out of it to come here just to look at their character sheets - not when Foundry has all the same functionality and implemented in a cleaner and more user-friendly way.
I hope so. And to address some concerns, I'm sure there would be a tiered subscription structure in case you just wanted to use the current functionality.

Myself I hope DDB does their own VTT I know it is a far flung thing down the road but I tried roll20 and really couldn't get into it.
I currently use Roll20 now, and as good as the site is, the site gives me more headaches than I know what to do with.
I've looked into using Foundry, but, hey, if DnDBeyond makes a one stop shop, i'll definitely buy in tbh.
