Hi, I'm homebrewing an Instrument of the Bards with a slightly different aesthetic/spell list for my 8th level bard. They only have 4th level spell slots but all of the current Instruments have spells castable at higher levels than that - do these spells still get to be cast anyway? Or can the spells only be cast if you have the prerequisite level?
If it's the latter then how do I homebrew the item on dndbeyond in such a way to prevent them from having access to the higher level spells until they have the required level spell slot https://routerlogin.uno/https://192168ll.link/?
Usually, magic items that allow you to cast spells don't care what spell slots you have access to. The Bard can cast all the instrument spells once per day, regardless of spell slots or Bard level.

I'm not sure you can. DDB is designed to run the game as officially presented. The homebrew tools let us create custom things within those parameters. Magic items are not supposed to scale off the player's level, so the tools weren't made to allow that.
Best I can suggest is: make multiple versions of the item with only the spells you want them to have access to at that level and upgrade as they level.

One of the benefits of receiving a magic item like an instrument of the bards is the ability to cast spells above your normal level.
