Its mechanically a LORE bard but is reskin for a setting appropriate new class. What I am trying to do is create a homebrew 'subclass' that a Bard can select at level 1 (not level 3) If I try to do the same thing with a knowledge cleric or fiend warlock and it works fine because they are selectable at first level by default.
I am having no problem adding all the extra things (like free GM awarded proficiency) and if i take 3 levels in the bard homebrew in DnD beyond i can select it as a homebrew subclass. I just can't work out how I can select it a subclass at level 1 dip . (bards/rogues/fighters etc)
I think i need to ' trick' the Bard College to appear at level 1 not level 3?

Not possible. The only classes can take a subclass at 1st level are Cleric, Sorcerer, and Warlock.
So ive been banging my head against the wall for about 6 days attempting to create the Aberrant Mind subclass, can i hell get the spell list to work at different levels! The options come on at level 1, great...then it goes down hill, level two three random options appear with nothing in the choices, level 3 & 4 they all dissapear then the initial three choices appear again level 5
absolutley lost now at to what the hell ive done!
has anyone created this subclass, named it somthing different and has published it ... as im about to deduct the level 1 spells and add them into a feat for my player as a workaround 😩 help guys im losing the plot?

You mean the Psionic Spells feature? You don’t really need to use Options at all. Here, this aught to help:

You'll need to give a full list of the spells you reference in the homebrew to get any real help with that. That way people can check and see what's causing the issue.
I used Charm Person, Protection from Evil and Good, Calm Emotions, Warding Bond, Beacon of Hope, Hypnotic Pattern, Banishment, Aura of Life, Geas, Greater Restoration, and Truesight.

Which version of Aura of Life did you use — the 2014 one or the 2024 one?
The 2024 version of Aura of Life is included in the 2024 Basic Rules, but the 2014 Aura of Life was not included in the 2014 Basic Rules. It's possible you've got the wrong one in there and that's the issue.

When I open My Homebrew Collection it is there.
I didn't or can't remember clicking a button to add it.

In one of my class features, I have 2 actions, but the second action isn't being displayed anywhere in the character sheet
You have to designate an “Activation Type” for the action. If it’s not an action, bonus action, or reaction, then designate it as “Special.”
